Reparations for International Wrongs: Creating a Claims Commission for Ukraine

Patrick W. Pearsall is the Director of the International Claims and Reparations Project at Columbia Law School in New York and a partner with Gibson, Dunn & Crutcher LLP in Washington, DC. He is widely recognised as a leading scholar on remedies under public international law, with his prior experience including his role as the Chief of Investment Arbitration at the US State Department and a lecturer at the law schools of Yale, Harvard and Georgetown Universities.
In this lecture, hosted by the International Committee of the NSW Bar Association, Mr Pearsall will speak about the principles of international law governing the making of reparations by states that have violated international law, together with practical strategies for, and impediments to, recovering assets of recalcitrant states to fund those reparations. In speaking on these matters, Mr Pearsall will be drawing on his experience as President Zelensky’s appointee to develop an international compensation mechanism for Ukraine, which has led to the passing of a United Nations General Assembly Resolution and the establishment of an International Claims Commission for Ukraine within the framework of the Council of Europe.
