Thursday, 6 August at 5pm - NSWBAR Common Room - Part 1 - Common law estoppels by representation, deed and convention
After an insightful presentation in relation to litigation estoppels at the Bar Association’s Sydney CPD Conference earlier this year, Quintin Rares is presenting a further 2 part series on the law of Estoppel, addressing Common Law estoppels of estoppel by deed, convention and representation (in Part 1 of the Series) and equitable estoppels of proprietary and promissory estoppels (in Part 2 of the Series).
Hosted by the Education Committee, join Quintin Rares, 7 Wentworth Selborne who will cover the non-litigation common law estoppels, being, estoppel by representation, estoppel by deed and estoppel by convention.
It will answer the key questions related to each, namely: what it is, who is bound, what are they bound to and is it a rule of substance or evidence? It will also answer some subsidiary questions, for example, whether a party is bound to an untrue representation and whether each doctrine operates on a representation of fact, law and or mixed fact and law. This process will delineate the similarities and differences between the doctrines.
The ultimate purpose of the presentation is to assist in the process of identifying the relevant doctrine/s when confronted with a particular set of facts.
